Dialog Play Terms and Conditions

 

  1. By installing the Dialog Play app, you confirm that you understand, agree to and will be bound by these terms of use. Please review them carefully before installation and/or acceptance.
  2. Dialog Axiata PLC (“Dialog/We/Us/Our”) reserves the right to modify these Terms at any time without prior notice. Such modified Terms and Conditions will be periodically updated herein, and you should refer to Our Terms and Conditions updated at https://dialog.lk/tc/dialog-play-app-terms-and-conditions regularly to ensure that you have the latest terms and conditions at your disposal. Your continued use of the Dialog Play app, constitutes your acceptance of such modified terms and conditions.
  3. All Intellectual Property Rights in or relating to Dialog Play (including but not limited to information, communications, designs, logos, pictures, layouts, software, texts, graphics, links, sounds and any other form of copyrightable content), are owned by Dialog or by Dialog licensors.
  4. You hereby grant to Dialog a perpetual, irrevocable, royalty-free, world-wide license to reproduce, transfer, modify, adapt and/or publish any Content provided by you to Dialog by email, post or otherwise on the Sites and/or the Services as Dialog sees fit and without notice to you, to the extent necessary to provide Dialog Play to you and others, and from time to time to improve Dialog’s products and services.
  5. Dialog hereby grants you a limited, revocable, non-transferable, non-exclusive license to install and use the Dialog Play application on any compatible mobile device that you own or control and/ or in connection with your Dialog Television.
  6. Dialog shall have the authority at its sole discretion to decide on an applicable fee for the OTT Services provided to you via the Dialog Play App.
  7. Any personal information you supply to Dialog when using this application will be used by Dialog in accordance with its Privacy Notice, which is available at https://www.dialog.lk/privacy-notice
  8. The Dialog Play app is to be used by a single user only and you are liable for any unauthorized use of this application. You acknowledge that you are responsible for ensuring that no unauthorized access to the Sites and the Services is obtained using your Access Information and that you are liable for all such activities conducted through your account whether authorized or not. When choosing Access Information, you must not use words that are obscene, abusive or likely to cause offence.
  9. The Dialog Play mobile application requires internet data connection for initial installation and for use and Standard Data charges will be applicable for all the content consumed for Video-on-Demand (“VOD”) services including Lions Gate Play (“LGP”) and SONY LIV (“SL”) services specifically marked within the Dialog Play app , charges shall apply for data usage. You will be notified and prompted within the app before accessing or purchasing such content.
  10. Dialog reserves the right to collect error information relating to login details with the intent of providing you with an uninterrupted service and an improved customer experience.
  11. If you are a customer with a Dialog TV connection, upon registering your Dialog TV account on the Dialog Play app, you agree to be bound by the Dialog Television On the Go Terms and Conditions in addition to these Dialog Play Terms and conditions. In case of a conflict between the 2 sets of terms and conditions aforementioned, the Dialog Television On the Go Terms and conditions shall take precedence
  12. Terms and Conditions on Liability, Termination, Exclusion of Liability and/ or any other terms and conditions not expressly set out herein shall be governed by the General Terms and conditions, available at https://www.dialog.lk/dialog-terms-and-conditions.
  13. Please note:
    1. Wherever, the term “ OTT Services” has been used in these Terms and Conditions, such term shall mean and include Over the Top services including the delivery of the Services to a closed user group of Subscribers through public Internet in the Territory for reception, viewing and streaming purposes (only) on the Media Devices;
    2. Wherever, the term “ Dialog” has been used in these Terms and Conditions, such term shall mean and include Dialog Axiata PLC and its subsidiaries Dialog Broadband Networks (Private) Limited and Dialog Television (Private) Limited as applicable.
  14. Lionsgate Play and SONY LIV (LGP & SL)
    1. The subscription video-on-demand service currently branded as ‘Lionsgate Play’ and ‘SONY LIV’ is integrated and available to authorized subscribers via the VIiU+ app.
    2. LGP & SL a has granted Dialog, a limited, non-exclusive, non-transferable, non-sub-licensable license to offer the LGP & SL Service in the relevant territory to the authorized subscribers purchasing the LGP & SL Subscriptions via the Bundled Plans on the Dialog Platform.
    3. All rights, licenses and interests in the LGP & SL Service (including all distribution rights for the content therein), the LGP & SL’s API and all parts thereof, and all rights not specifically granted to Dialog or otherwise authorized, including the intellectual property rights in the content on the LGP & SL Service, the LGP & SL Artwork, and the LGP & SL Marks, are and shall be entirely reserved by LGP & SL. For clarity, Dialog has no control and/or editorial right over the LGP & SL Service provided by LGP & SL. LGP & SL retains all ownership, title, and interest in and to the LGP & SL Service and LGP & SL’s API, including but not limited to LGP & SL Artwork, LGP & SL Marks, and LGP & SL designated key art of the LGP & SL Service.
    4. The services provided by LGP & SL made available on the Dialog Play app are provided by LGP and are not owned by Dialog. Dialog assumes no responsibility or liability for any errors or omissions in the services or the content provided by LGP & SL, made available on the Dialog Play app and shall not be held liable for any loss or damage that may arise from your use of the services provided by LGP & SL.
    5. By accessing this service, you confirm that you are 18 years of age or older.
    6. It is your responsibility to prevent unauthorized access to this content by minors. We encourage you to review the Dialog Play terms and conditions for a comprehensive understanding of our engagement with . LGP & SL
    7. As per Clause 9, for all LGP & SL services and subscriptions, charges shall apply for data usage regardless of the network used.
